Prenuptial and Postnuptial Agreements

A prenuptial or antenuptial agreement is a marital agreement created before two people become married. A postnuptial agreement is a marital agreement created after the wedding. Both prenuptial and postnuptial agreements are on the rise.

It may be difficult to think about marriage as if it were business, but when it comes to creating a pre or postnuptial agreement, that is exactly the approach you should take. The agreement is not an exit strategy, just protection against an unforeseen “what if” circumstance or an important “insurance policy” on the legal issues of the marriage contract.

A prenuptial agreement is more common in second marriages, especially if one owns a business, has significant debt, or has significant assets or earnings. Postnuptial agreements are created to help resolve issues in a marriage by removing a source of disagreement whether it is finances, assets, children, chores, etc. These agreements are used for many reasons such as controlling behaviors such as adultery or over spending, protecting money received as an inheritance, or simply experiencing a change in investment income.
