Michigan Divorce Process
Michigan is a “no fault” divorce state – there is only one ground for divorce: “a breakdown of the marriage relationship to the extent that the objects of matrimony have been destroyed and there remains no reasonable likelihood that the marriage can be preserved.” However, that doesn’t preclude the court from considering fault as a factor if there are disputes regarding spousal support, child support, property division or custody and parenting time.
The divorce process can be complex and frustrating. Under Michigan law, a divorce judgment may not enter in less than 60 days for couples with no children and the wait expands to a minimum of six months when there are children involved.
