Covenants Not To Compete
In many states, including Michigan, properly drafted covenants not to compete can, and are, regularly enforced to protect businesses. The key, however, is that they must be properly drafted. If the document is insufficient in its definitions, or if it is too broad and overprotective, the court will label it as unenforceable.
There is a fine line that must be walked, and it is a path we have taken successfully with our clients time and time again.
